Allahabad HC Makes Display Of Notice For Inter-Faith Marriages Optional, Calls It Violation Of Privacy

The Allahabad High Court, in a landmark judgment on Wednesday, ruled that the publication of notices for inter-faith marriages which was mandatory till now be optional so as to protect the liberty and privacy of the couples.

In the Special Marriage Act of 1954, couples performing any inter-religious marriage had to give written notice to the District Marriage Officer. The law provided for affixing the notice to the marriage officer's office for 30 days. The Allahabad High Court has called it a violation of privacy.

Judge Vivek Chaudhary made it clear that now married couples have the option whether they want to make the notice public or not. The order states that if the married couple refuses to make the notice public, the marriage officer can neither make it public nor cancel the marriage.
