Assam Police Arrests Gujarat MLA Jignesh Mevani For ‘Tweets Against PM Modi’, Tweets 'Withheld'

Gujarat MLA from Vadgam and social activist Jignesh Mevani was arrested by Assam Police from Circuit House in Palanpur, Gujarat,  in the early hours of Thursday for tweets calling Prime Minister Narendra Modi a ‘lover of Godse’. The complainant, Anup Kumar Dey from Bhabanipur, Kokrajhar district, had said that Mevani’s remarks on Twitter that Modi considers Godse as a ‘god’, and that Modi should appeal for peace and harmony in violence-affected areas of Gujarat like Himmatnagar, Khambhat, and Veraval, could incite communal tensions, creating law and order problems.

The complaint alleged that the tweet “caused widespread criticism and has the propensity to disturb public tranquility, prejudicial to maintenance of harmony among a certain section of people. It is more likely to incite a section of the masses belonging to a certain community to commit any offence against the other community in this part of the country.”

Accordingly, cases were registered under sections 120B (criminal conspiracy), section 153(A) (promoting enmity between two communities), 295(A) (injuring or defiling place of worship with intent to insult the religion of any class), 504 (intentional insult with intent to provoke breach of peace), 506 (criminal intimidation) and various sections of the IT Act.

Twitter has also withheld two tweets by Mevani based on a “legal demand”. Mevani is an independent MLA who extended support to the Congress in September 2019. State elections in Gujarat are due in. December 2022.
