Hathras: Supreme Court Directs Allahabad HC To Monitor CBI Probe In Alleged Gangrape Case

The Supreme Court on Tuesday ordered the Allahabad High Court to monitor all aspects, including the CBI investigations, in the alleged gang-rape and subsequent death of a Dalit girl in UP's Hathras. The top court was hearing a batch of petitions seeking a court-monitored probe into the case. 

"So far as the transfer is concerned, it is appropriate for the investigating agency to complete the investigation," a bench headed by Chief Justice SA Bobde said.

The three-judge Bench comprising of CJI SA Bobde, Justice A S Bopanna, and Justice V Ramasubramanian, also accepted Solicitor general Tushar Mehta’s request and asked Allahabad HC to delete the name of the rape victim from its orders in a PIL relating to the incident.

On the plea of transferring of trial in the case to Delhi, SC said since CBI is investigating the incident, there should be no apprehension about the mistrial. However, it said the issue will be kept open and would be taken up, if needed, after the completion of the probe into the case.SC also

UP government as well as right activist lawyers led by Indira Jaising had requested the court jointly for a CBI probe into the Hathras alleged gangrape case and monitoring of the probe by SC.
