SC: ‘Suspension Of MLAs Beyond Session Unconstitutional And Illegal’

The Supreme Court has overturned a Maharashtra assembly resolution suspending 12 BJP MLAs for a year for alleged disruptive behaviour. The Supreme Court stated today "suspending the MLAs beyond the sessions is unconstitutional and illegitimate."

While the regulations allow for suspension for the duration of the session, the 12 MLAs were suspended for a year. The Supreme Court ruled, "Assembly resolutions are contempt in the eyes of law and are deemed ineffective."

They were removed from the legislature on July 5 last year after the state government accused them of "misbehaving" in the Speaker's chamber with presiding officer Bhaskar Jadhav.

Sanjay Kute, Ashish Shelar, Abhimanyu Pawar, Girish Mahajan, Atul Bhatkhalkar, Parag Alavani, Harish Pimpale, Yogesh Sagar, Jay Kumar Rawat, Narayan Kuche, Ram Satpute, and Bunty Bhangdia are the 12 members of the Legislative Assembly.

Anil Parab, the state Parliamentary Affairs Minister, proposed the suspension resolution, which was approved by voice vote.
