No Order In SC Hearing On Lakhimpur Violence Case Today

The Supreme Court has concluded today’s (8th October) hearing in the Lakhimpur Kheri violence case and has not passed any order in the matter. It has expressed dissatisfaction with the status report filed on its orders by the Uttar Pradesh government. The three-judge Bench led by N.V. Ramana stated that “we are not satisfied with the steps taken by the state government.

During the hearing, CJI ramana said that given the seriousness of the matter, it has not proceeded accordingly. He said that “it seems that action is being taken only through words” and expressed the hope that the government and police would act responsibly.

Ashish Mishra, the son of Union Minister Ajay Mishra Teni, has been charged under IPC 30 (Murder), but not been arrested yet. Regarding this, the CJI asked that “When the charge is as serious as 302 then how will the accused be treated?” and he further stated that going by how the mater is being investigated, it seems that it is not being taken seriously.

Senior advocate Harish Salve appearing for the Uttar Pradesh government said that the postmortem report does not mention bullet wounds. The court reprimanded him on this and asked whether this is the basis for not having arrested the accused.  Salve further said that two bullet caps were recovered from the scene.

Justice Surya Kant, one of the three judges of the Bench, said that “This is a matter of 8 people killed inhumanely. The law should take its course against all the accused”. To this, Harish Salve said that this will be made up for within today and tomorrow.
