 Only Marriage Between ‘Biological’ Man And Woman Legal, Centre Tells Delhi HC

During a hearing of a clutch of petitions arguing for recognition of same-sex marriage under Special Marriages Act and Foreign Marriage Act, the Union government told the Delhi High Court that “marriage” as it is contemplated under the law, “is between a biological man and biological woman” through solicitor general Tushar Mehta.

The petitions also included a plea for allowing a foreign-origin spouse of an OCI (Overseas Citizen of India) cardholder to be registered without regard to sexual orientation or gender. The three petitioners are Joydeep Sengupta (OCI), Russell Blaine Stephens (American), and Mario D’Penha, and Indian PhD student and queer-rights activist at Rutgers University, US.

A final hearing on the matter has been posted on November 30th.
