 Pegasus: Petitioners Want Independent Probe, Centre Refuses To File Affidavit

The Supreme Court is currently hearing a clutch of petitions related to the deployment of the Pegasus spyware illegally against political opposition, media, and civil society. It had adjourned the last hearing on September 7 to today, after Solicitor General Tushar Mehta asked for more time to respond on behalf of the government.

Senior Advocates Colin Gonsalves says that the principal wrongdoers in the matter, i.e. the Central and State governments, cannot be asked to form a committee and investigate. He said there were more than 5000 cases of interception by authorities. Similarly, Sr. advocate Meenakshi Arora called for a SIT under a retired judge and Sr. advocate Rakesh Dwivedi has said that “it is a question of credibility” and therefore the government should reveal whether or not it used the spyware.

The Centre has refused to file an affidavit in this regard. The SG reiterated the point of national security. The Bench has reserved and will pass an interim order in 2-3 days.
