The Supreme Court on Wednesday stayed the Bombay high court judgment of acquitting a man of groping a 12-year-old as there was no skin to skin touch. The judgment sets a dangerous precedent, the advocate general has said.
The Bombay High Court had last week acquitted the accused on grounds that ‘no skin-to-skin’ contact was made.
Centre has challenged the Bombay High Court order that said groping of a child’s breasts without skin-to-skin contact would not amount to sexual assault under the POCSO act.
The Supreme Court has issued a notice to the Maharashtra government and the accused.
