SC On Pegasus: Can't Remain Mute Spectator On 'National Security' Grounds

The Supreme Court has announced the formation of a three member expert committee to probe the Pegasus spyware case, saying that "justice must not only be done but be seen to be done".

It said that it cannot stay mute on the matter just because the Centre had submitted "national security" as a grounds for not providing any information on whether it had used the spyware to hack into phones of citizens, including journalists and political opponents. 

The Court maintained that while Fundamental Rights have restrictions, those must withstand constitutional scrutiny. Privacy is an important fundamental right and since many of the petitioners claim to have been directly affected by deployment of the software in their devices, the court was bound to look into their pleas,  The Committee has been asked to submit its report in 8 weeks.
